You may have typed “CBD oil vs cannabis oil” into Google. If you did, you might have come away more confused than when you started. You’re not alone.
Even major retailers, wellness blogs, and “experts” get it wrong - lumping all cannabis extracts into one big green pot.
But one thing I need to clear up is that CBD oil and cannabis oil are NOT the same thing.
They may come from the same plant family (Cannabis sativa). But they’re extracted differently. They are used differently and regulated very differently, especially in the UK.
If you’ve ever wondered what you’re actually putting in your body, this is your straight-talking guide.
Learn why one bottle might be 100% legal, while another could land you in trouble. Understand CBD oil vs cannabis oil once and for all.

Let’s start with the simple basics: everything begins with the cannabis plant.
Within that plant, there are two key varieties. These are hemp and marijuana. Both are members of the Cannabis sativa species, but they are bred for completely different purposes.
So while they share the same botanical name, their chemistry - and their legal status - couldn’t be more different.
Imagine they are two cousins from the same family:
One is a chill wellness coach, which is hemp.
The other is a party-lover with a medical degree, which is marijuana.
CBD oil is short for cannabidiol oil. It is extracted from the flowers, leaves, and stalks of the hemp plant.
This plant is the non-intoxicating cousin of cannabis.
It contains high levels of CBD and trace amounts of THC. This composition makes it completely legal to buy, sell, and use in the UK when it meets regulatory standards.
CBD interacts with your body’s endocannabinoid system (ECS). This network maintains balance (homeostasis) across your mood, sleep, and immune function. It also affects pain perception and stress response.
Unlike THC, CBD doesn’t bind directly to receptors or make you “high.” Instead, it gently supports your body’s natural regulatory process. Think of it as tuning your body back into harmony.
Most quality CBD brands use CO₂ extraction. This method is the cleanest and solvent-free. My Way CBD uses this technique to pull cannabinoids and terpenes from hemp.
The result is a potent and pure oil. It can be blended into carrier oils like MCT, olive, or hempseed oil. This makes it easy to use under the tongue.
Here’s where the confusion usually starts.
“Cannabis oil” is a broad term. It can technically refer to any oil derived from the cannabis plant. In everyday language, it’s used to describe THC-rich oil made from the marijuana variety of Cannabis sativa.
This isn’t your average wellness supplement.
It’s a medical-grade extract, typically prescribed for serious health conditions such as severe epilepsy, multiple sclerosis, or chemotherapy-induced nausea.

In the UK, cannabis oil containing more than 0.2% THC is (rightly or wrongly) classified as a controlled substance under the Misuse of Drugs Regulations 2001.
It sits in Schedule 2, the same category as morphine.
That means it’s illegal to sell or possess unless prescribed by a specialist doctor through the medical-cannabis programme.
What if you come across a website claiming to sell “cannabis oil” freely to UK customers? It may not be a licensed dispensary.
🚩 Red flag. It’s almost certainly hemp-derived CBD oil, rebranded (and misrepresented) as “cannabis oil” to catch clicks and confuse customers.
Adding another layer of confusion: hemp oil.
Most supermarket “hemp oils” are actually hemp seed oil. It is a nutritious, cold-pressed oil made from hemp seeds. It is not made from the plant’s flowers or leaves.
Hemp seed oil is a great source of omega-3 and omega-6 fatty acids. It makes a lovely skin moisturiser and great to use in cooking and in salad dressings. However, it contains zero CBD or THC. It offers no interaction with the endocannabinoid system. If you’re buying it for “CBD benefits,” you’re wasting your money.
Quick recap:
| Oil Type | Source | Contains CBD | Contains THC | Psychoactive | Legal in UK | Typical Use |
|---|---|---|---|---|---|---|
| CBD Oil (Hemp-Derived) | Hemp flowers/ leaves | ✅ | Trace (<0.2%) | ❌ | ✅ | Wellness & ECS balance |
| Cannabis Oil (Marijuana-Derived) | Marijuana | ✅ | ✅ High | ✅ | ❌ (Prescription only) | Medical use |
| Hemp Seed Oil | Hemp seeds | ❌ | ❌ | ❌ | ✅ | Nutrition / skincare |

The key difference comes down to how each oil interacts with your brain and body.
Let’s make it crystal clear:
| Product | Legal to Sell in UK? | Contains THC | Notes |
|---|---|---|---|
| CBD Oil | ✅ Yes | ≤0.2% | Must come from approved hemp strains & have lab verification. |
| Cannabis Oil (THC >0.2%) | 🚫 No | High | Prescription only under medical cannabis programme. |
| Hemp Seed Oil | ✅ Yes | 0% | Legal food/supplement oil - no CBD content. |
The FSA (Food Standards Agency) oversees CBD product compliance, while the Home Office regulates THC content.
So any brand that doesn’t provide a Certificate of Analysis (COA) proving its THC level and cannabinoid breakdown?
Avoid it. Period.
Here’s how to separate genuine CBD oil from the sea of fake “cannabis” products:
| Compound | Found In | Psychoactive | Main Effects |
|---|---|---|---|
| CBD (Cannabidiol) | Hemp & Cannabis | ❌ No | Calms the nervous system, supports sleep, reduces inflammation, balances ECS |
| THC (Tetrahydrocannabinol) | Cannabis (Marijuana) | ✅ Yes | Alters perception, increases dopamine, strong pain relief, appetite boost |
CBD helps regulate how your body responds to stress;
THC changes how your brain perceives reality.
That’s why CBD oil can be part of a healthy daily routine, but cannabis oil is strictly a controlled product.

This point deserves repeating. This is where all cannabinoids - CBD, THC, and even your body’s own - do their work.
The ECS is made up of receptors (CB1 and CB2). Endocannabinoids your body produces naturally, and enzymes that break them down.
When this system falls out of balance (thanks to chronic stress, poor diet, toxins, or trauma). Symptoms show up as anxiety, pain, fatigue, sleep problems, hormonal imbalance, and inflammation.
CBD doesn’t override this system; it supports it.
THC activates it more forcefully. This activation can be beneficial medically. However, it is not something that should be taken uncontrolled or without expert guidance.

When shopping for CBD oil, focus on these essentials:

The UK draws a hard legal line between CBD oil and cannabis oil. Other countries take a far more flexible approach. In some cases, they take an enlightened one.
The rules vary widely. Rightly or wrongly, they often have more to do with politics and profit than public safety.
Let’s take a quick world tour of where things stand:
CBD derived from hemp (with less than 0.3% THC) is federally legal under the 2018 Farm Bill, though cannabis oil legality still varies state by state.
For example, California, Colorado, and Oregon have fully legalized both CBD and THC cannabis products for recreational and medical use. Idaho and Nebraska remain far more restrictive.
So legality depends entirely on your ZIP code.
Canada legalized both CBD and cannabis oils nationwide in 2018 under the Cannabis Act.
Medical and recreational use are fully permitted, provided products meet Health Canada standards for safety and labelling.
It’s one of the most progressive cannabis markets in the world - and an example of regulation done right.
Thailand is rapidly emerging as Asia’s wellness-cannabis hub, where plant medicine meets regulation.
CBD products are legal for general use, and cannabis oil can be prescribed medically.
In 2022, Thailand became the first Asian nation to decriminalize cannabis. Though recently laws have been tightened again, so the scene continues to evolve fast.
Germany recently legalized personal possession and limited home cultivation of cannabis for adults (2024), while maintaining its medical cannabis programme.
CBD oil is fully legal as long as it contains no more than 0.2% THC.
The country’s goal? Transition cannabis from taboo to taxation - a model many in Europe are watching closely.
The Netherlands has long been famous for its cannabis “tolerance” policy.
CBD oil is legal and widely available, while cannabis oil (THC-rich) remains officially illegal but decriminalized in small quantities.
In short: tolerated, not fully legal - a gray area the Dutch seem happy to maintain. Where cannabis use is neither legal not illegal.
Switzerland allows the sale of CBD products with up to 1% THC. This is one of the highest legal limits in Europe.
Cannabis oil containing more THC is restricted but can be prescribed medically.
Swiss law treats hemp as a wellness product rather than a threat - and the market is booming.
CBD oil is legal for topical use. It is not officially allowed for human consumption (an EU regulatory loophole that makes things murky).
Cannabis oil remains illegal, though private use and cultivation are largely tolerated.
Spain’s “social clubs” quietly operate in legal gray zones, serving as community-driven wellness hubs.
Italy permits CBD oil with <0.6% THC (yes, higher than the UK’s 0.2% limit).
Medical cannabis oil can be prescribed by doctors for specific conditions.
Italy also grows some of Europe’s best hemp - proving that smart regulation and economic opportunity can coexist.
CBD oil was reclassified as a Schedule 3 medicine in 2021. This reclassification means low-dose CBD can be purchased over the counter at pharmacies without a prescription.
Cannabis oil remains prescription-only, though medical access has expanded significantly under the Therapeutic Goods Administration (TGA).
CBD oil is legal for sale and use. The daily dose must be under 20 mg, and the product must contain less than 0.001% THC.
Cannabis oil (THC-rich) remains illegal for commercial sale but decriminalized for personal use and possession.
South Africa is seen as one of the most promising future markets in Africa’s cannabis economy.
Japan maintains some of the world’s strictest cannabis laws. However, CBD isolate (zero THC) is legal. It is increasingly popular for wellness.
All THC - even trace amounts - remains strictly banned, with harsh penalties for possession.
Across the world, the line between CBD oil and cannabis oil is constantly shifting. Laws change. Attitudes evolve. But one thing stays the same - understanding the difference matters.
The rule is simple, no matter where you are. Whether you’re in London, Lisbon, or Los Angeles. It applies to anywhere in between:
✅ Know what’s in your bottle.
✅ Know the law where you live.
✅ Only buy from transparent, lab-tested brands that show exactly what’s inside.
Governments may regulate plant medicine in different ways. They might do so rightly or wrongly.
However, the truth remains constant:
Nature’s medicine works best when it’s respected, understood, and used responsibly.
CBD oil, cannabis oil, and hemp seed oil all share the same roots, but their roles couldn’t be more different:
So next time you see “cannabis oil for sale” online, remember this: If it’s legal, it’s CBD oil. It is not medical cannabis.
And if it’s cheap, untested, or vague about what’s in the bottle, step away from the cart.
Because when it comes to your health, knowledge is empowerment.
When you know what you’re taking — and why — you take back control of your wellbeing, naturally.
